These terms and conditions (“Terms”, “Agreement”) govern the portrait photography services provided by Dan Oxtoby Photography (“Photographer”, “we”, “us”, or “our”) and your use of these services. By booking a portrait session with us, you (“Customer”, “you”, or “your”) agree to be bound by these Terms and Conditions.

1. Services Provided

• Included: Our portrait session package offers approximately 10 minutes of shooting time, allowing for 1 to 6 images to choose from.
• Location: You have the freedom to choose the location for the session, whether it’s your home or an indoor venue you have access to.
• Duration: A typical session lasts around 10 minutes per person, though add 15 minutes per additional individual.
• Group Size: Generally, We shoot individuals, but we can accommodate up to 3 people together, with pricing determined by the number of people and location.
• Style: Portraits are usually captured in black and white with a black background, following an editorial, strong-looking theme.

2. Booking and Payment

• Booking Process: Sittings can be booked online via my website, with full payment required at the time of booking.
• Cancellation and Refunds: A full refund is available within 48 hours of booking, with a 50% refund possible for cancellations beyond that. Rescheduling within 5 working days of the shoot incurs no fee.
• Payment Structure: Full payment is required to secure your session date. A 12 x 9 print is included in this fee, then an option to buy a variety of different prints is offered. The one free 12 x 9 print is included for the entire shoot, regardless of how many sitters are booked for the shoot.

3. Print Delivery

• Turnaround Time: Edited images are typically delivered within two weeks via an online gallery. Prints are usually delivered within 10 working days of ordering from our website.

4. Styling and Extras

• Outfit Recommendations: We recommend having two top garments to choose from, considering the black and white nature of the shoot.
• Props: You’re welcome to bring personal items for the session.
• Retouching: While we carefully retouch all edits, reasonable retouching requests may be accommodated.

5. Customer Responsibilities

• Appearance: It’s your responsibility to ensure the desired appearance during the shoot, including hair, makeup and clothing correctly worn.
• Satisfaction Guarantee: Though we strive for satisfaction from my customers, refunds or re-shoots due to dissatisfaction are not accepted.

6. Copyright and Liability

• Copyright: All images taken during the portrait session remain the exclusive property of Dan Oxtoby Photography. Any reproduction, distribution, or public display of these images without my explicit written permission is strictly prohibited.
• Liability: Dan Oxtoby Photography shall not be held liable for any loss, damage, or injury arising from the use of his services, including but not limited to accidents, injuries, or damages to property.

7. Miscellaneous

• Travel Fees: Travel fees are calculated based on a specified radius.
• Digital Files: Only prints are provided; digital files are not available.
• Pets: Pet inclusion depends on the circumstances and may be accommodated.
• Session Duration: We allocate 30 minutes from arrival to departure, with adjustments of 15 minutes for each additional individual booked.
